Declaration on the Establishment of the Committee for Human Rights in Viet Nam
The Universal Declaration of Human Rights (UDHR), ratified by the United Nations General Assembly on December 10 in 1948, has been called “The First Declaration of all mankind” and “the common ideal that all peoples and nations must achieve.” It asserts a principle recognized by the world community, that is: “The basis of all human rights must be defended by a law-abiding regime to avoid any uprising against brutality and repression as a final resort.” It has such a great philosophical value and spiritual prestige; it seems to convey a power that eventually becomes legal enforcement. Articles 1 and 2 stated:
1. “Article 1: All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.”
2. “Article 2: Everyone is entitled to all rights and freedoms set forth in the Declaration, without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.
Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it is independent, trust, non-self-governing or under any other limitation of sovereignty.”
Nowadays, human rights have become the common language of mankind. The recognition of human rights has been considered as a foundation for freedom, peace and justice in the world. Conversely, the ignorance and disregard of human rights have led to brutal acts and angered human conscience. The existence of a world in which everyone can enjoy freedom of expression and belief, absent from terror and poverty, has been claimed to be the highest aspiration of man.
Human rights connect closely with human nature, and this has been commonly accepted and shared by the community of mankind. Human rights cannot be removed since they are born with each person, not provided by the state or anyone. The denial of human rights means having disregard for human dignity, violating the most sacred and creative part of a human being. This is the cause of destruction of mankind. The negligence or contempt for human rights is the main cause of many pain and suffering for the community, the people, and corruption in the government.
Under the Vietnamese communist dictatorship, although the human rights are mentioned in its Constitution as well as in international covenants signed by the Vietnamese communist government. In reality, these rights have not been properly observed and truly enforced since some of these basic rights have been restricted or even being denied. In many areas, human rights are seriously violated. When rights and lawful privileges are being violated, the citizen can only file complaint to government officials, but these complaints never resolved reasonably, and there is not a human right organization exists to protect these aggrieved citizens. The voices of the aggrieved citizens are echoing from all corners of the country.
All violations of human rights must be denounced and judged, and no violation shall be justifiable before the law.
The protection of human rights is the collective responsibility of all progressive mankind, for the protection of human rights is the protection of human dignity and of mankind itself.
The legal ground of the establishment of the Committee for Human Rights in Viet Nam:
- Based on the Universal Declaration of Human Rights, the International Covenants on Human Right signed by Viet Nam
- Article 69 of the Viet Nam 1992 Constitution,
For the above reasons, we the undersigned proclaim today, December 10, 2006, declare to establish the Committee for Human Rights in Vietnam (CHRVN).
The Committee for Human Rights in Viet Nam is founded for the purpose of defending the human rights stated in the Universal Declaration of Human Rights as well as in other international covenants. CHRVN is an independent non-governmental, non-partisan, and non-profit organization. It is not a political group. Its activities are based on justice, fairness, and the truth. Its duty is to protect, advocate, and advance human rights, namely:
- To educate and advocate for human rights to all population.
- To observe and report monthly, quarterly, and annually on the human rights status in Vietnam.
- To send human rights reports to the Vietnamese government, public agencies, international human rights organizations, and mass media in Vietnam and abroad to alert on human right violations.
- To voice up in defense of Vietnamese citizens and foreign residents in Vietnam when their human rights are violated.
- To cooperate with international human rights organizations and foreign governments to protect human rights.
The Committee for Human Rights in Viet Nam will work closely with the Alliance for Democracy and Human Rights, Bloc 8406, Viet Nam Independent Union, United Workers-Farmers Association and other political parties in the front of protecting human rights.
We unanimously call on international human rights organizations, foreign governments, peace, freedom, and justice loving peoples in the world; and Vietnamese people inland and oversea, to support and assist CHRVN on it cause.
